This includes individuals who have applied for permanent residency through a variety of channels, including family sponsorship, employment-based sponsorship, refugee or asylum status, and other categories.

To be eligible for a green card, the individual must meet the specific requirements of the immigration category through which they are applying. For example, an individual applying for permanent residency through employment-based sponsorship, such as the EB-5 Immigrant Investor Program, must meet the requirements of that program, including making a qualifying investment and creating or preserving at least 10 full-time jobs for U.S. workers.

Once the USCIS approves an individual's application for permanent residency, they will receive a green card, which is proof of their status as a lawful permanent resident of the United States. The green card grants the individual the right to live and work in the United States permanently, and it also provides a path to citizenship for those who meet the eligibility requirements.

Investors who have been approved for an EB-5 visa may apply for a permanent green card once they have met the requirements of the program and have been granted conditional permanent residency. The conditional permanent residency is granted for a period of two years.

To apply for a permanent green card, an investor must file an I-829 Petition with the USCIS within 90 days prior to the expiration of their conditional permanent residency. The I-829 Petition must demonstrate that the investor has met all of the requirements of the EB-5 program, including:

1. Making a qualifying investment in a new commercial enterprise or designated regional center.

2. Creating or preserving at least 10 full-time jobs for U.S. workers within two years of the investor's admission to the United States as a conditional permanent resident.

3. Maintaining the investment in the new commercial enterprise or designated regional center for the entire two-year conditional period.

If the USCIS approves the I-829 Petition, the conditions on the investor's permanent residency status will be removed, and they will be granted a permanent green card. The permanent green card is valid for 10 years and can be renewed indefinitely as long as the investor continues to meet the requirements of the EB-5 program.
